Terms of Service

1. Agreement

By downloading, installing, or using the GroundsPass mobile app or the groundspass.app website (together, the "Service"), you agree to these Terms of Service ("Terms"). The Service is operated by Small Dev Shop Inc ("we"). If you don't agree, please don't use the Service.

2. What GroundsPass does

GroundsPass shows crowdsourced, near-real-time wait times for courts at Grand Slam tennis tournaments. Wait times come from other users who submit reports while on the grounds. We do not own, operate, or represent any tournament, and we are not affiliated with Wimbledon, the US Open, the French Open, the Australian Open, the ATP, WTA, ITF, or any associated organization.

When you submit a wait-time report, you represent that:

We may remove reports, suspend accounts, or limit functionality if we detect abusive or fraudulent activity, including location spoofing.

Wait times shown in GroundsPass are a crowdsourced estimate, not a guarantee.

Tennis lines change quickly. A court that was 15 minutes out five minutes ago could be 45 minutes out now, or empty. Use GroundsPass as one input alongside your own judgment, the tournament's own signage, and staff direction. We are not responsible for matches you miss, sessions you can't get into, or any other loss that follows from relying on a wait-time estimate.

The GroundsPass app is currently free to use. If we introduce paid features or subscriptions in the future, we will make pricing clear before you are charged.

The GroundsPass name, logo, app, and website are owned by Small Dev Shop Inc. These Terms do not grant you rights to our branding or source code. Trademark mentions of tournaments (Wimbledon, US Open, etc.) are used nominatively — we do not claim affiliation or endorsement.

9. User contributions

By submitting a wait-time report, comment, or other content, you grant us a worldwide, non-exclusive, royalty-free license to display, aggregate, and distribute that content through the Service. Aggregated data (estimated wait times, heatmaps) may be published anonymously outside the Service (for example, in marketing or media coverage).

10. Third-party services

The Service relies on third parties (Apple, Google, Supabase, Expo, and others). Your use of those services is also governed by their own terms and privacy policies. We are not responsible for third-party services or their availability.

11. Disclaimers

The Service is provided "as is," without warranties of any kind.

We don't promise the Service will be uninterrupted, accurate, or error-free. Wait-time data depends on other users' reports and can be wrong, stale, or missing. Confirm critical plans with the tournament itself.

12. Limitation of liability

To the maximum extent permitted by law, Small Dev Shop Inc is not liable for any indirect, incidental, consequential, or punitive damages, or for any loss of profits, opportunities, data, or goodwill arising out of the Service. Our total liability for any claim will not exceed the greater of (a) $50, or (b) the amount you paid us in the 12 months before the claim.

13. Termination

You may delete your account at any time from the app or by contacting us. We may suspend or terminate your account for any reason, including violation of these Terms. When your account ends, your access stops and your data is handled as described in our Privacy Policy.

14. Changes to these Terms

We may update these Terms as the app changes. For material changes we will notify you in-app or by email before they take effect.

15. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes will be resolved by binding arbitration under the rules of the American Arbitration Association in Delaware, except that either party may pursue claims in small-claims court if eligible. You waive any right to participate in a class action.

16. Apple App Store terms

If you downloaded GroundsPass from the Apple App Store, these additional terms apply: (a) these Terms are between you and Small Dev Shop Inc, not Apple; (b) Apple is not responsible for the app or its content; (c) Apple has no warranty obligation for the app; (d) Apple is a third-party beneficiary of these Terms and may enforce them against you; (e) you represent that you are not in a country subject to a US embargo or on any US Government list of prohibited parties.
